Preserve and Protect Webster's and Tew's Falls Greensville

Members of the Greensville Community have worked (and fought "tirelessly) for years to get to a place where the HCA has finally accepted accountability to manage a shuttle from Christie Lake. Although we still have some work ahead, the traffic congestion has improved immensely and we have a much safer community for both residents and guests. Greensville now has a Counsellor who is working to help, she is engaged and is supporting the community and therefore the City has approved increased fines and bylaw enforcement.

It is therefore disturbing to see some residents in the area promoting parking in their driveways and lawns for money on weekends. It goes against everything the community groups have been fighting for and jeopardizes the success of the Christie Lake Shuttle.

Let’s not forget where we were, and how far we have come. Please support your community and our goal to Preserve and Protect the parks and this special place we call home.

Why are the well taps fenced off with a swipe card gate access?

New regulations for drinking water quality standards in Ontario came into effect January 1, 2018, specifically related to arsenic concentrations, which put the well above the new prescribed standard.

Ontario drinking water quality standards apply to small drinking water systems and the well is considered such by Hamilton Public Health Services. The alternative to closing the well was to change its operation, and this includes adding fencing, issuing swipe cards, putting up signage and requiring users to sign a waiver.

How will well users be able to access the area?
Through swipe card access only at the gate and fence system at the well.

Now more than ever it is so important to protect our Artisan spring and restore FREE ACCESS.

Hamilton City Council, sitting as the Board of Health and pending ratification at next Wednesday's Council ratification meeting, voted 10-0 to declare a Climate Change Emergency in Hamilton.
The effect of the wording is not the same as a "State of Emergency" under the Municipal Act, however, it was chosen to denote the seriousness of Climate Change to the future of our City, and the very question of if humanity will continue to exist on this planet.
With approximately 80 members of the public observing the daytime proceedings, Council spent nearly three hours debating. First, a "lite" motion that would've directed staff to research how to act on Climate Change, to create a mandate for a staff Climate Change Task Force.
The "lite" motion was amended following strong debating points by Ward 1 Councillor Maureen Wilson, and Ward 9 Councillor Brad Clark. Now the motion called for action, directed staff to report on how the City can accelerate its actions to cut carbon emissions quickly, research and draft changes to bylaws, zoning, policies, and economic growth plans to ambitiously move Hamilton towards being a carbon neutral municipality with the goal of being carbon free.
One of the more fascinating dynamics this term of Council is Wilson and Clark, sitting on opposite ends of the horseshoe shaped Council table using their debating points to force Mayor Fred Eisenberger to act upon the positions he articulates - words which are usually empty platitudes with any action by the Mayor.
Having secured amendments, and a consensus around the Council horseshoe, to pass a motion that had all the appearances of seriously acting on climate change, it was Ward 3 Councillor Nrinder Nann's turn to push the file forward.
Whereas Mayor Fred Eisenberger was concerned about amendments pushing for action were risking dividing Council and preventing an unanimous vote, Nann called the political bluffing. After two hours of debate, Nann put the motion on the floor to declare a Climate Change Emergency "Let's just take the political will and courage right now, declare the emergency and move forward with the plan of action".

Yesterday, the #ParisGaltMoraine Conservation Act received all party support and passed second reading in the legislature!

Mike Schreiner has taken a giant step towards protecting the Paris Galt Moraine. He has worked for months to write the legislation, consulting with water experts, First Nations, municipalities, farmers and MPPs from all parties. While votes often fall along partisan lines, yesterday was different, with unanimous support from all parties. Water protectors everywhere are celebrating.

But we can't just sit back and wait. Wherever you live in Ontario, please Call Your MPP and let them know you support Bill 71 and the protection of the Paris Galt Moraine. This bill could pave the way for similar protections for moraines across Ontario.

The water walk movement began in 2003 when Grandmother Josephine Mandamin, who was growing increasingly concerned with the pollution of lakes and rivers, was introduced to a prophecy from an elder within the Three Fires Midewiwin society warning that "water will cost as much as gold" by the year 2030. For the Anishinaabe, water is associated with Mother Earth and it is the responsibility of grandmothers to lead other women in praying for and protecting the water.

Josephine set out on her first walk in 2003 around the perimeter of Lake Superior to raise awareness about the abuse and disrespect of water, encouraging humanity to rekindle the sacred relationship and connection to Nibi (water). Since this initial walk, Josephine has walked 17,000km around the shorelines of all the Great Lakes and sparked a movement of water walkers who host their own community walks.

She completed her last sacred water walk in 2017 with the Great Lakes Water Walk, for which Ecologos and the Water Docs Film Festival was a founding partner. We were so honoured to walk with Josephine that day and are forever grateful for her advocacy and her teachings.

Legal action threatened in dispute over Ancaster well water

Ancaster Coun. Lloyd Ferguson raised the possibility of getting a restraining order against Save Our Spring at the Dec. 7 board of directors meeting, objecting to "slanderous comments" about his role in the dispute.

These include describing him, in a letter and on the group's website, as a "champion of only one solution, privatization" and as an opponent of reclassifying the well "to allow free continued access," he said.

Save Our Spring – Protecting the Ancaster Well

So recapping again – a little history on SOS – Save our spring was formed in the Spring of 2017, after the April announcement in the Ancaster News that the Ancaster Well was having an Arsenic Scare. At the dining room table of Chris Krucker – Manorun Farms, he called together a small group of people, that he hand-selected to form a community group under the guise of protecting the water rights to the Ancaster Well.

I was asked to be one of those “executive” members, I received a call with an invitation to meet at his farm to discuss forming a committee to protect the Ancaster Well. I agreed but with reservations, and our first meeting there were 5 of us, and at the time I felt flattered that they valued my professional expertise, and I had strong feelings toward the well, so I promptly offered to build a website and logos and branding, made posters and signs, and got about trying to save a well.

I was excited and I did lots of research and I was ambitious, and I was looking for alternative solutions, however I quickly learnt that Chris believed he had the personal ear of Lloyd Ferguson and that we should work only with Lloyd towards a solution, he said, “We have a Councillor that is willing to work with us, so we should do what he says” and his idea was that we gather volunteers and take surveys at the well. I offered to handle the online work, but refused to participate in well surveys and we agreed to disagree, and I went on to speak with the Spring Valley group, against Chris’s direct wishes. By this time our initial group of 6 was now down to 3 – which we called ourselves the “executive” meaning we didn’t have to share info with everyone just us. Recapping the time line a lot happened in Sept. there was no longer a health order to shut the well, SOS is discussing with Lisa Burnside the possibility of Spring Valley purchasing the Well (sept 29th).

The following day after the Spring Valley meeting Lloyd held a meeting to announce the Fence and Swipe Card, knowing there was no Arsenic scare, and we were told this community endeavour was over. Chris Krucker jumped on board, agreed with the fence and that is when SOS split. I kept hold of the website and logo and Chris vowed to form a new group called The Valley Water Waters. He was going to watch the water – Valley Water Watchers is Chris Krucker. We have not spoken since.

But wait there is a third and very active group called PAWS – Protecting Alternative Water Sources – and they have been instrumental in truth seeking with the Ancaster Well. I mentioned above that Chris Krucker our self-appointed leader amongst the SOS team was against doing any real research, he and the leader of PAWS Erin Davis had a very different approach to finding a community solution and Chris could not see past his own very narrow view point, after some heated discussions, in public meetings and in private - Chris banned Erin from the SOS group. At the time I did not comply with his orders, he wanted SOS to dis-engage from Erin’s research and remove any mention of them from the SOS website. I have not done that to this day because we are a community where everyone has a voice. You can find out more about the PAWS group at saveourspring.ca along with all the back history of the well.

The PAWS group has not ceased to search for the truth, they continue to uncover documents that show that there was never an Arsenic scare at the Ancaster Well that would of required a shut down. Just signage.

So why would Lloyd Ferguson and Chris Krucker not continue working towards the alternate solutions that would honor the land deed and kept the well in public hands? Why the Fence?

This is a letter from the Health Dept City of Hamilton to the Hamilton Conservation Authority with regard to the claim of “imminent closure” by Councillor Ferguson. – Save Our Spring

So let’s continue our recap – we now all know that on Sept 6th SOS sent a letter to the Health Dept explaining that the Ancaster Well did not meet the criteria of a small drinking water system and was not subject to their interpretation, and we also had an offer on the table to consider a community group – Spring Valley purchasing the well, both of these options would have been in keeping with the language on the deed, which we believe Bill Kennedy put there.

So a little more recap folks - if you are reading along you know that the SOS team sent a letter to the Health Dept - the HealthDept responded directly to the HCA, and never responded to SOS they acknowledged in writing that there was no reason for a shut down of the Ancaster Well - seriously please read it. (These documents were recovered in months of searching from the PAWS TEAM!)

(The Hamilton Conservation Authority is responsible for most of the city, but the Niagara agency oversees land that drains into the Welland River, including parts of Glanbrook, Ancaster and Stoney Creek.)

Council appealed that change to a provincial tribunal and lost – but the budget battle is now before the courts.

The proposed board makeover could help end the financial dispute outside the courts, suggested Ancaster Coun. Lloyd Ferguson. "We could settle this through a simple resolution," he suggested.

If not, Ferguson also speculated about the prospect of the city using the past "illegal" board makeup as a new legal argument in the court battle.

As a result of this testing, a concern was identified with a water fountain.

The water fountain passed testing after flushing. As a result, we will continue to flush all drinking water fixtures each day before students arrive.

In addition to informing the Ministry of Education and Ministry of Environment and Climate Change, our Health & Safety representatives have consulted with Public Health to ensure appropriate corrective actions have been taken for the safety of your child. Peter Ormond hails from a large local family with ten siblings,
scattered across the region. That many siblings is a lot to keep
track of, but most have managed to stay in the area says Peter’s
brother Vince. “Our eldest brother John is in Ancaster, then there
is Mary who has stayed in Hamilton, Theresa in Oakville, and our
sister Anne, who departed from us much too soon and now rests
in Carluke Orchard Cemetary," says his brother Vince. "Peter was
especially close with Anne. Lawrence is in Montreal, Me (Vince) in
Hamilton, Mark, in Ancaster, then Paul and Mathew in Hamilton,
and Peter who was the famous seventh son and the baby, our
youngest brother, Tim who moved to Aurora.”

Being the seventh son in the family, Vince said Peter was always
a favourite of his father, who has since passed. With their father's
passing Peter and his siblings take an active role in spending
time and caring for their mum who continues to be very
independent.

Peter’s mum is now 88 and while all the siblings share in her
care, brother Vince is quick to acknowledge that Peter is very
active in including his mum in as many activities as possible,
and enjoys spending time his with her in the garden, or playing
scrabble at every opportunity.

“Peter really puts himself out there in the community, he often
brings new Canadian’s from the Bridging program that he
teaches to family gatherings. Peter has always been the one
that is able to bridge the differences in our own family too and
brings people together, he was always a good athlete and
an excellent musician and of all the boys in the family has also
managed to keep the most hair," says Vince.

Peter has embraced the community as his family, so when asked
for this article to share a family story, he stated simply that
the community and the planet are really his family. Peter has
spent the majority of his professional life working in the oil
industry – pipelines and oil sands, he has worked with the
Trans-Canada pipeline, it was this exposure to heavy industry
all across our country that resulted in a gradual epiphany that
he could no longer ignore. If he wasn’t willing to live and work
sustainably, then who would?

"I used to work in the Alberta oil patch. Then I had a shift in
perspective. I thought, 'If I’m going to make a difference, I need
to be part of that change.' So, at my house, I’ve simplified. I dug
out the pavement in the front and back and I removed the
driveway to create a raised-bed garden. I have raised beds in
the back for food, and wild areas to support pollinators and
critters. That ties back to urban wildlife, which we really need to
be aware of and protect," says Peter.

Peter made some life changing decisions and decided to practice
what he preaches. His house is energy sustainable. Solar panels
and heat exchanger on the roof. Rain barrels in the garden. As a
long time member of the Green Party and veteran Candidate for
our Ancaster riding. Peter is dedicated to local Politics as well as
conserving our Environment and has directed his life to that end.
“Professionally I now work with companies on energy audits,
make suggestions on how they can reduce energy use and help
them access provincial incentives. I see that as an extension of all
the conservation efforts, like saving habitat and protecting
wildlife. I am always working on being more sustainable, both
within the workplace and in my community.”

When not working hard or getting involved in local politics,
Peter spends his time being neighborly by cultivating his permaculture
edible garden. Each spring Peter organizes a community
effort to distribute strawberry plants, asparagus and pear trees
to encourage the community to plant food in their everyday
gardens. He donates seed packs and plants to teachers in kits
enough for every child that asks, planting seeds of change with
everything he does

Why have the well taps been fenced off with a swipe card gate access?

New regulations for drinking water quality standards in Ontario are coming into effect January 1, 2018, specifically related to arsenic concentrations, which will put the well above the new prescribed standard.

Ontario drinking water quality standards apply to small drinking water systems and the well is considered such by Hamilton Public Health Services. All Nations Water Ceremony

On April 14th, 2018 All Nations will be Gathering on the Worlds Purest known Aquifer in a form of extended ceremony for the Water.

It will be an all day event leading up to the ceremony:

• Information sharing about the Alliston Aquifer

• Guest speakers including Josephine Mandamin Autumn Peltier, Candace Day Neveau, Becky BigCanoe, Liz Osawamick, Tasha Beeds — we are awaiting confirmation of more speakers.

• Setting Intentions and Prayer Poles led by Elizabeth Brass Elson of Dumpsite 41 & WaterWalkers from For Earth & Water Walk 2017

• Stephanie Peltier will lead a dance from a dream she received. Women are asked to participate in this dance and be prepared by wearing skirts, jingle dresses or traditional clothing. We are hoping for about 200 dancers or more.

• Josephine Mandamin will then lead the water ceremony inside the circle we are creating. The ceremony itself will be continuous singing and prayer for the water contained in all the copper vessels. Everyone is required to bring a copper vessel.

• A feast will follow at the Waverly centre

**More details will be provided as to the ceremony, the logistics and event details in coming days**

**Everyone is asked to bring a copper vessel with them, a feast bundle, a reusable water jug, and a contribution of food or donation to cover costs of the feast**

**Please plan for rain and cold weather. DRESS WARM, bring an umbrella, a blanket or lawn chair for this outdoor event. It will go on rain or shine**

I am “well” thank you……..

People keep asking if perhaps I have gone off the “deep end” in my support for community access to the Ancaster Well.

If you were to judge the world by what you read in the Ancaster News, and after seeing my mug shot at least 6 times in the paper filling up a big water jug, you might guess that I am down there every week filling up, with placards, and signs and angry stomping “Save Our Spring”.

I would like to take a moment to let you know the real truth behind my relationship with the Ancaster Well. I have never actually ever filled up there ever or felt the need to gather water beyond my city fed tap to my house. That picture is a one time shot of me at the well.

So how did I become the face of the well? My profession is marketing, and I was asked to volunteer to help Save the Well by a local farmer. I like to get involved, so I offered to do the website and marketing, came up with a logo, posters, and quickly we garnered interest from the local newspaper and TV. This was great for our cause, however at the last minute my Farmer head piece was too busy to attend, and I was left holding the bag for the interviews.

Having never used the well, I found myself having to quickly get up to speed on the well’s history. I even confused the mineral well with the spring well in the beginning, I was accused of trying the manipulate the message to purposely stir the masses.

I read everything I could get my hands on so that I would not look like a fool when interviewed on Cable 14. I read the Federal water “guideline” (please note the language “guidelines is not enforcable by any law”), the Provincial, and the Water System Regulations. I read the history, and we met with the HCA. What became evident to me after properly researching this, (research…..which I am shocked that any members of the HCA had apparently never thought to do, or perhaps were never told to do.) The well did not meet the requirements of the water standard that was being applied, and as such what the HCA was feeding the public was a crock of poop. All the HCA had to do was send a letter to the Municipal Health Dept. explaining that the well was erroneously classified as a small drinking water system and later extensive research by local activist group PAWS revealed that this is exactly what the HCA did but never bothered to tell the public this, there is no health order to close the well. NONE!

Meanwhile our Councillor is in the news claiming himself the well’s champion and asking the public to feed all ideas through him….. at one point he even said

“This is something that we can offer to our community, offer to our citizens, that’s free of charge. It’s an artesian well and it doesn’t matter when you go there, somebody’s there getting some water, either in large tanks or a jug or whatever”

So I even shook LF’s hand at Heritage Days cause I was still hoping for this crusty old man yet. I am also super excited cause I feel like I found a loop hole. I write it all out, along with information we found concerning the the land deed and shared it with my SOS steering committee, and now since there is no health order to shut the well, and thru conversations with HCA it was revealed to us that there was an inclination to sell the well (to get out from their perceived liability). I suggested we look to existing community groups to purchase the well and protect the land deed, and have a big party. That was in July. The Steering committee further reviewed and discussed and were not comfortable with my suggestions to the point that I was accused of trying to usurp “authority” within our group of 3 remaining Steerers. What a joke. I resigned from the un-official steering committee shortly thereafter, and just decided to watch, and continue to support the website and digital media. I chose not to attend any more meetings as there was not open participatory dialogue. We were the steered – not the steering.

But yet my photo became the stock photo for the Ancaster Well with the Ancaster News, and every follow up story featured me at the well filling up that same bottle of water, and it was me on social media plugging the SOS, never the farmer who formed the group – not once on Social media or any farm events. I always thought that weird. So now when I go to 14O’s people are commenting – Jo – you in the news again, everyone is thinking I have my water activist hat on, and while yes, I do, it is not in the way that people are thinking it is.

I felt that the self purported leadership of the SOS really didn’t expect to find any solutions, and were perturbed by these wrenches in their “well” mapped out drama. I believe that this whole Arsenic health scare is a complete bait and switch, and there are people that had hoped and planned that I would have been a willing participant in this rouse and should done what I was told and fed the community the line of bull shit that they had prepared for me to publish online at their will.

I felt like I was being manipulated. There were volunteers at the well taking surveys and talking to people. The hand written survey data was never entered into the survey, figures presented at the “hand off” meeting when our farmer bowed down to the HCA. The information from the surveys clearly showed that 85% of the people were opposed to the fence or closure. It showed that 90% of the people lived within a 10k radius of the well and that area also has the LOWEST rate of cancer etc in the region. The SOS management did not act of behalf of the community as it pledged to do.

So why did the Councillor LF INSIST on fencing in the well and charging a fee to use? Why did he not honor the land deed with City of Hamilton and the HCA or the memory of William Kennedy who’s legacy this is?

This story is still unfolding…..

The Ancaster Well could of, and should remained as it was, open to the public in perpetuity as legally defined in the bill of sale.

But it’s not – or well is in jail.

The fence must go.

After a period of time the owner of the property could potentially sell it to itself with a new use.........

By fencing in the Ancaster Well, the HCA has achieved - Change of Use -

This will allow the HCA to "lift" the Legacy of Farmer William Kennedy! Protect Public Access to this Heritage Well!

Change of Use - You can be considered to have sold all or part of your property even though you did not actually sell it.

For example, this is the case when:

you change all or part of your principal residence to a rental property;
you change your rental property to a principal residence; or you stop using a property to earn or produce income.

Every time you change the use of a property, you are considered to have sold the property at its fair market value (FMV) and to have immediately reacquired the property for the same FMV, unless you make an election as described below. The resulting capital gain or capital loss (in certain situations) must be reported in the year the change of use occurs.

If the property was your principal residence for any year you owned it before you changed its use, you do not have to pay tax on any gain that relates to those years. You only have to report the gain that relates to the years your home was not your principal residence.
